Consumer Duty Roadmap

The Consumer Duty will reform the way in which firms operate.

 

There are a number of specific requirements under PRIN 2A which impact firms throughout the distribution chain, these requirements are explicit in nature meaning firms will need to undertake certain reviews / assessments which contain specific information.

This short guide details the key steps you’ll likely need to complete to be ready for the Duty.

The Financial Conduct Authority’s Consumer Duty makes several changes to PRIN, specifically introducing a new PRIN 12.

We have copied out the new PRIN 2A requirements into a more manageable format, you will be able to use the list as a checklist or starting point for a gap-analysis.

Template Certificate for the Certification Regime (SM&CR)

These Certification Templates are worded to ensure compliance to the Certification Regime under the Senior Managers & Certification Regime. Firms will be required to check & confirm (‘certify’) that certified staff are suitable to do their job & provide certification.

FCA Authorisation Guide

This template sets out all audit areas you need to consider when preparing a firm to be regulated by the Financial Conduct Authority (FCA).  

 

The template is perfect for the following firms:

  • Consumer credit lenders

  • Debt collection businesses looking to operate in the consumer credit market or collecting consumer credit agreements

  • Debt buyers purchasing consumer credit regulated portfolios

 

 

 

It is also important to ensure that you apply for the right permission. Whether you need to apply for limited permission or full permission depends on the regulated activities your firm will carry out. You can use the link to the FCA’s decision-making tool below to find out whether you need to apply for limited or full permission. You should bear in mind that your authorisation application will be delayed if you apply for the wrong permission category.

Fair Processing Notice Template

This template is an example Fair Processing Notice under GDPR for creditors and debt collection sectors; this example is for data provided by consent, compliant with GDPR.

FPNs are to be used by firms to tell individuals how their personal data will be collected, stored, processed and retained. They allow for compliance with the General Data Protection Regulation, as a way of keeping data subjects’ informed. The new data protection laws (GDPR) require changes to existing privacy notices. Our free example fair processing notice sets out information that needs to be included to ensure compliance, helping firms to make sense of the transparency requirements under the GDPR.

 

Please note the example Fair Processing Notice is only to be used as guidance, each firm will have to amend it to fit the way in which they process data.
